According to a source who spoke to People, their ongoing separation “has the potential to get ugly,” particularly because the couple chose not to sign a prenuptial agreement before their marriage.
The insider revealed that “there are some sticking points over financials” between Lopez, the internationally renowned singer and actress, and Affleck, the two-time Oscar-winning actor. This tension arises as they navigate the division of their considerable assets.
Under California state law, only the income and assets acquired during their marriage are “considered community property and subject to division.” This means that their shared assets, including their $60.8 million Beverly Hills mansion, will be included in the community property and will be subject to division.
To avoid a protracted and potentially messy court battle, the couple is reportedly undergoing mediation. Mediation can offer a faster and more private alternative to traditional divorce proceedings. As explained on Wagner & Bloch’s website, “Divorce mediation is an alternative dispute resolution process where a third-party mediator guides a separating couple to resolve issues related to property distribution, child custody, alimony, and other divorce matters.”
Despite the potential for a rocky legal process, reports suggest that Affleck is maintaining a positive outlook. An insider shared that the Triple Frontier star is “happy” and “doing well” amid the divorce. “He’s where he wants to be: close to his kids and in a neighborhood that he loves. He enjoys working too, and is very focused on the positives,” the source added.
